Ninth Circuit to examine district court’s faulty interpretation of JFK Act

The nonprofit Mary Ferrell Foundation (MFF), which maintains the largest online repository of records related to the assassination of President John F. Kennedy, filed suit against President Biden and the National Archives and Records Administration (NARA) in October 2022, charging the defendants with failure to enforce the President John F. Kennedy Assassination Records Collection Act (“JFK Records Act” or “JFK Act”).

The JFK Act, a sweeping law Congress passed unanimously in 1992, mandates the public release of all assassination-related material in the government’s possession. Thirty-two years after it was passed, thousands of records are still withheld.

In January 2024, Chief Judge Richard Seeborg of the U.S. District Court for the Northern District of California dismissed all but three of MFF’s claims — i.e., litigation over (1) congressional JFK records, (2) destroyed JFK records, and (3) archival finding aids.

The plaintiffs believe Judge Seeborg has made serious errors of judgment and now challenge his decision. On May 28, MFF filed an interlocutory appeal in the United States Court of Appeals for the Ninth Circuit, asking the appellate court to address issues the lower court dismissed or ignored, even as the lower court settles the surviving claims.

24 JUNE, 2024 update on the Byrd, von Alvensleben, Doolittle Report FOIA case

24 JUNE, 2024. This morning the US Supreme Court acted on our petition for certiorari in the Byrd/von Alvensleben/Doolitte report FOIA case (Case no. 23-1207).  The court denied the petition without further comment.  The Supreme Court only agrees to hear approximately 1% of the cases submitted to it and denies the others without comment.

Nevertheless, it is disappointing that the court did not take the opportunity to apply transparency to the JFK assassination.

In May, 2024, “Petition for a writ of certiorari filed.” was submitted to the United States Supreme Court RE: Assassination Archives and Research Center, et al., Petitioners v. Central Intelligence Agency.

David Talbot has suffered another health crisis

[David Talbot has served on the Board of Directors for the AARC. He is a respected author and journalist who has devoted great energy and courage to progressive and challenging issues throughout his distinguished career. His Amazon Author’s Page may be found HERE]

The Following was posted to David Talbot’s Facebook homepage today, 10 June, 2024:

We’re saddened to inform you all that David has suffered a near-fatal stroke. It happened as he and his wife, Camille, were having to move out of their family home of 30 years, and it’s left both David and Camille in a scary and precarious place, not knowing where they’ll live on top of this agonizing event.
As a result of this shocking and heartbreaking ordeal, the Talbot family is asking for your help in two specific ways:
A GoFundMe has been set up to help cover David’s medical expenses and ongoing care. Up until this point, David had been supporting himself and Camille through one small stream of income from his writing, which he will not be able to return to anytime soon or possibly ever, given the severity of this stroke. Suddenly without income or long-term housing, we’re seeking some small relief for the Talbots as they navigate this trying time.
Secondly, specifically for those of you in the Bay Area, we’re looking for any leads on an apartment in San Francisco at a reduced rate. The apartment they were set to move into is no longer suitable for David and they are not able to stay in their previous house long-term, so if you know of an apartment in the city, if you own a vacant apartment, or if you know someone who might, your help here would be a godsend and resolve one incredibly pressing, time-sensitive burden.
It’s unclear if, or how much, David will recover at this time. This stroke was unfortunately much more severe than his previous one seven years ago. He currently struggles to form words, which, for a writer and speaker of David’s stature, has been incredibly hard for him and painful for all of us to see. But we feel confidently that, against great odds, he understands much of what we’re saying and that his beautiful spirit remains astonishingly intact. After 72 years of life, David was looking forward to beginning to slow down, to write less out of necessity for once, and to begin to write simply for pleasure. This event has thrown a wrench into that plan, but we hope that through his unrelenting will, and through the generous support of you all, that he’ll be able to recover to a point where he can indeed finally rest.

Remembering 1968: The loss of RFK

56 years ago this week, Senator Robert F. Kennedy won the California democratic presidential primary and lost his life. Coming just two months after the assassination of Dr. Martin Luther King, Jr., these losses disrupted our political history and indelibly marked 1968 as a year of irreversible tragedy.
